Flower Mound Updated Its Land-Use Rules on Noise, Zoning Protests, and Home Businesses

Three Parts of Flower Mound's Land-Use Code Changed This Year

If you run a business from your home — or live next door to someone who does — the rules have shifted. Same goes if you've ever filed a zoning protest or wondered exactly how the town measures noise.

The town's Planning Services page confirms that Ordinance No. 04-26 amended the Land Development Regulations in three areas: noise, notice and protest procedures for zoning changes, and home occupations. All three changes came in response to the 89th legislative session of Texas.

The home-business piece touches the most residents directly.

During that session, the Texas Legislature passed H.B. 2464, which limits city authority to regulate "no-impact home-based businesses." It took effect June 12, 2025. Flower Mound's ordinance update brought the town's home-occupation rules in line with that state mandate.

What makes a business "no-impact"? Under state law, four things must be true: the total number of employees and clients on the property at any one time stays within the town's occupancy limits; cars parked on the street and overall traffic levels must not rise in any meaningful way because of the business; none of its activities are visible from the street; and it does not substantially increase neighborhood noise or violate the town's noise ordinance. Meet all four, and the town cannot shut you down or require a permit.

The bill restricts municipalities from adopting ordinances that prohibit no-impact home-based businesses or require a license, permit, or other approval for operating one. The town still has enforcement authority, though. Home businesses must still comply with fire codes, health regulations, and noise ordinances.

On noise, the ordinance now anchors enforcement to Article III, "Noise Control," of Chapter 34, "Environment," of Subpart A of the town's code. Sound regulations tied to activities at food service establishments are handled separately, under Section 437.029 of the Texas Health and Safety Code.

The third change updates the formal process for residents and property owners responding to proposed zoning amendments. Notice is published in the town's official newspaper. A written protest must be received by 5:00 p.m. on the Tuesday before a regularly scheduled Monday council meeting. A protest sent by mail must reach the town secretary before that same deadline.

If you qualify as no-impact under both state law and the updated town code, you're on solid legal footing. One caveat: the law does not override homeowners association rules or private deed restrictions, so check your HOA covenants separately.

Living near a home business? Noise and visibility standards haven't loosened. The town can still enforce both.
